Sealed Proposals for Construction Manager/General Contractor (CM/GC) services for Clean Water Services’ (Owner) Forest Grove Primary Treatment Project No. 7190 (Project) will be electronically received from Proposers by Stephen Waldron, Program Support Specialist, via Equity Hub’s Bid Locker at https://bidlocker.us/details/3818_Forest_Grove_Primary_Treatment_Project (Bid Locker) until 2:00 P.M., (PST), on January 29, 2024 February 5, 2024. Before Proposers can submit their Proposals, they will need to register with Bid Locker at https://bidlocker.us/Home/bidlockerus. There is no cost to register. Owner will not accept late Proposals or Proposals that are faxed, mailed or emailed. The Proposals will not be publicly opened or read aloud.

The Project includes the following components:

1.         Preconstruction services, including value engineering, constructability and construction sequence reviews, preparation of a Guaranteed Maximum Price (GMP) proposal, and other services.

2.         Construction services, including:

a.     Site clearing and earthwork cut and fill to achieve grading of the Project area.

b.     Excavation, dewatering, and construction of an auger-cast pile foundation.

c.     Construction of two new 100’ diameter primary clarifiers.

d.     Construction of a new primary clarifier pump gallery.

e.     Construction of a new building including an electrical room and a room housing future process equipment.

f.      Construction of associated processes and structures, including a concrete flow distribution structure, a packaged lime handling system, a chemical storage building including tanks and chemical handing equipment, and an engineered media biofilter system to treat foul air from the clarifiers and associated infrastructure.

g.     Grading, drainage, electrical, and associated yard piping to tie into the existing infrastructure.

The Project schedule is regulatory-driven, and Owner is undertaking CM/GC services with the expectation of an accelerated schedule relative to a traditional design-bid-build approach. Achieving substantial completion of the Project by September 30, 2025, and final completion, including commissioning, start-up and performance testing by October 31, 2025 is a high priority for Owner.

Owner wishes to hire the CM/GC Contractor to benefit from, among other things, the CM/GC Contractor’s assistance in Project planning. Services will be provided in two phases: Phase I, pre-construction services, and Phase II, construction services as described in the attached RFP. Owner intends to negotiate the price for each phase separately. The CM/GC Contractor will provide pre-construction services throughout the design of the Project. At the completion of the design, or at any point in the pre-construction phase, prior to the completion of design, as may be required by Owner, the CM/GC Contractor will be required to provide a GMP Proposal to act as the CM/GC Contractor for the construction and assume the risk of delivering the Project on schedule at or under the GMP. Acceptance of the GMP Proposal, issuance of a GMP Amendment by Owner and Notice to Proceed will initiate the construction phase, which will include providing construction of the Project.

The site of the Project is located at the Forest Grove Water Resource Recovery Facility (Forest Grove WRRF) at 1345 SW Fern Hill Road, Forest Grove, Oregon 97116 (Site). 

The estimated contract price for the construction phase of the Project is $30 Million.

The Proposal requirements, detailed procurement process description, schedule, and evaluation criteria are contained in the RFP.

The Proposer shall guarantee the entire Proposal for a period of 90 calendar days from the date of submittal.

Prospective Proposers are encouraged to attend a pre-Proposal meeting via Microsoft Teams, that will begin at 10:00 A.M. (PST) on January 16, 2024, and last approximately one hour. The purpose of the pre-Proposal meeting is to discuss the scope of the Project and Proposal requirements. Owner will provide the Microsoft Teams Meeting information ahead of the pre-Proposal meeting by Addendum. Detailed technical questions may be submitted in writing until 5:00 P.M. on January 22, 2024, but they will be answered, if warranted, by Addenda. Oral statements may not be relied upon and will not be binding or legally effective.

Prior to submitting its Proposal, Proposers shall be licensed with the Oregon Construction Contractors Board as required by ORS 701, and thereafter comply with the requirements of ORS chapter 701 with respect to licensing. Prevailing wage rates must be paid on the Project in accordance with ORS 279C.800 to 279C.870. Proposers need not be licensed under ORS 468A.720 (regarding licensing of contractors on projects involving asbestos abatement).  Proposers and subcontractors will be required to have a public works bond filed with the Construction Contractors Board before starting work on the Project unless there is an applicable exemption under ORS 279C.836(4), (7), (8), or (9).

Proposers shall be qualified in accordance with the applicable provisions of ORS chapters 279A and 279C in order to submit a Proposal for public work in Oregon.

Owner reserves the right to cancel this solicitation or reject any Proposal that does not comply with all prescribed public bidding procedures and requirements, including the requirement to demonstrate the Proposer’s responsibility under ORS 279C.375(3)(b) as that term is used in any applicable Owner’s Purchasing Rules and ORS 279A.010(1)(r). Owner may reject any Proposal in accordance with ORS 279C.395 and may cancel the solicitation or reject, for good cause, any or all Proposals upon after finding that doing so is in the public interest.
